Terms of Service

1. Introduction

Welcome to Prime Property ("Platform", "we", "us", or "our"). Prime Property is operated by Sahil, a Sole Proprietorship based in Bhopal, Madhya Pradesh, India. By accessing or using our website and services, you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

2. Nature of Services & Intermediary Status

Prime Property is an online marketplace that connects property buyers and sellers. We act solely as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

We do not own, buy, sell, or broker any property listed on the Platform. We are not a licensed real estate agent, broker, or dealer. All property listings are submitted by third-party users (owners, brokers, or agents), and we are not responsible for the content, accuracy, or legality of such listings.

3. Disclaimer of Warranties

While we make reasonable efforts to verify property listings within 7 days of submission, we do not guarantee the accuracy, completeness, legal title, ownership, existence, or availability of any property listed on the Platform.

The Platform and all its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Buyers and investors must conduct their own independent due diligence, including but not limited to title verification, legal compliance, encumbrance checks, physical inspection, and RERA verification before entering into any property transaction.

4. Limitation of Liability

To the fullest extent permitted by applicable law, Prime Property, its owner (Sahil), employees, contractors, and affiliates shall not be liable for:

  • Any financial loss, fraud, or damages arising from the use of this Platform
  • Any transactions, disputes, or agreements between buyers and sellers
  • Inaccurate, misleading, or fraudulent listings posted by third-party users
  • Loss of data, profits, or business opportunities
  • Any indirect, incidental, special, consequential, or punitive damages

In no event shall our total liability exceed the amount paid by you (if any) for using the Platform's services in the twelve (12) months preceding the claim.

5. User Conduct & Responsibilities

By using the Platform, you agree to:

  • Provide accurate, truthful, and up-to-date information in all listings and communications
  • Not upload fake, misleading, fraudulent, or illegal content
  • Not impersonate another person, entity, or broker
  • Not use the Platform for any unlawful purpose or in violation of any applicable law
  • Not scrape, crawl, or harvest data from the Platform without written consent
  • Not circumvent, disable, or interfere with the Platform's security features

We reserve the right to remove any content, suspend, or permanently ban any user account without prior notice if we determine, at our sole discretion, that the user has violated these Terms or engaged in harmful behaviour.

6. Intellectual Property

The Platform's design, logo, branding, software, and original content are the intellectual property of Prime Property. You may not reproduce, distribute, or create derivative works without our prior written consent.

By uploading content (photos, descriptions, etc.) to the Platform, you grant us a non-exclusive, royalty-free license to use, display, and distribute such content on the Platform for the purpose of facilitating transactions.

7. Third-Party Links & Services

The Platform may contain links to third-party websites, services, or advertisements. We do not endorse, control, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and subject to their respective terms.

8. Indemnification

You agree to indemnify and hold harmless Prime Property, its owner, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Platform after any modifications constitutes your acceptance of the revised Terms.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in Bhopal, Madhya Pradesh.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
